Terms of service

Navimask is the virtual private network or VPN operated by ONTINET. By activating Navimask, your Internet traffic will be encrypted and your IP will be replaced by another IP to help you better protect your privacy from websites and Internet Service Provider (ISP).

To use Navimask, as a user you will need to download and install the ONTINET VPN Software whose function is limited to this purpose only.

To protect your privacy as a Navimask user, ONTINET applies a series of protocols and security measures to this service in order to maintain constant compliance with leading standards in the sector and with Spanish and European Union regulations applicable in Spain in terms of information security, cybersecurity, secrecy of communications, personal data and the guarantee of digital rights.

1.- NAVIMASK, OFFERED BY ONTINET

1.1 Navimask is offered by ONTINET. COM. S.L., with NIF B-96840467 and registered office at Calle Martínez Valls, 56, post code 46870, Ontinyent (Valencia), Spain. You have the contact details at the end of this Agreement.

2.- WHO CAN CONTRACT NAVIMASK

2.1 Navimask can only be contracted by legal or natural people of legal age who reside in countries where the use of VPN is permitted.

3.- WHAT IS NAVIMASK

3.1 Navimask - Navimask consists of the provision of a licence to use ONTINET's VPN Software designed for the user to enjoy this virtual private network, understood as a computer network technology that allows browsing and interacting with enhanced privacy on public or demilitarised networks.

3.2 Licence Scope - The ONTINET licence offered for Navimask is limited, personal, non-transferable, revocable, non-exclusive and non-sublicensable. The licence does not in any way imply the sale of any software.

3.3 VPN Software to use Navimask - To use Navimask, the licence requires you to install and maintain the VPN Software provided to you by ONTINET for the sole purpose stated. This VPN Software may not be transformed or used by you or any third party for purposes other than those set out in this licence agreement. Upon expiry of the licence you have contracted, the programme will cease to be useful for enjoying this service.

3.4 Number of devices - You will only be able to use Navimask from the number of devices corresponding to the licence you purchase from ONTINET.

3.5 Technical requirements for the VPN Software - The VPN Software provided by ONTINET to give you access to Navimask can only be installed on the operating systems indicated in each case at the time of contracting the licence. As long as you keep the licence active, you must install the periodic updates that ONTINET offers for this software.

3.6 Duration of the licence - The licence to use Navimask will remain active for the period you have contracted.

4.- TECHNICAL SUPPORT

4.1 While your license remains active, ONTINET offers you continuous and free technical support in Spanish for the VPN Software that you need to keep installed and active to enjoy Navimask.

4.2 ONTINET will strive to keep Navimask active permanently, though it may experience interruptions due to factors beyond its control. In the event of an unstable connection or outages, the user may contact ONTINET for appropriate support.

4.3 This technical support service will be provided on request and within reasonable times through the channels that ONTINET makes available for this purpose.

5.- CODE OF CONDUCT

5.1 Navimask has been designed for use solely for legal activities and purposes. ONTINET does not tolerate the use of Navimask for activities contrary to the law, customary practices, and general legal principles.

6.- HOW TO SUBSCRIBE TO NAVIMASK

6.1 Subscriptions to Navimask can only be made through distribution channels authorized by ONTINET.

6.2 ONTINET may occasionally offer discounts for Navimask. These discounts will only be valid if offered by ONTINET or by an ONTINET-authorized partner, with the discount conditions specified in writing, including the period during which the discount will be valid. Discounts will be applied automatically or by entering a code provided by the user, as applicable. Discount codes with retroactive effects will not be accepted, nor will they entitle the user to receive their value in legal tender.

6.3 During the subscription process, you will be offered the license options that are available at that time. If you choose the auto-renewal option, it will be automatically renewed at the end of each term. Payments are made at the beginning of each subscription period. ONTINET will make Navimask invoices available to you through the channels that ONTINET has designated for this purpose.

7.- WITHDRAWAL FROM THE CONTRACT

7.1 You may withdraw from the subscription through your user panel by clicking the button to withdraw or cancel the contract only within the first fourteen calendar days from the first day you can use Navimask. If you withdraw, ONTINET will refund the full amount paid for the use of Navimask before the end of the fourteen calendar days following the moment you notified your decision to withdraw. You cannot withdraw after this period or after a manual or automatic renewal of the contract.

8.- CANCELLATION OF THE SUBSCRIPTION

8.1 Cancellation for automatic renewal licenses. If you purchase an automatic renewal license, please remember that you need to manually cancel the automatic renewal if you wish to terminate the subscription. By deactivating the automatic renewal, you can continue to enjoy Navimask until the current term ends.

8.2 Cancellation for limited-term licenses. If you have purchased a limited-term license to use Navimask, the subscription will be automatically canceled at the end of this term.

8.3 Cancellation due to technical issues. Each device is different, and ONTINET cannot know how you have configured yours or which ISP provides your Internet connection. For these and other technical reasons, you might not be able to use Navimask normally until you resolve the issues on your device or connection. If ONTINET unilaterally or mutually determines that the identified technical problems will impair or prevent the installation of the VPN Software or the normal functioning of Navimask, the contract will be terminated, and the license will be revoked from that day.

8.4 Cancellation for violation of the Code of Conduct. If ONTINET becomes aware by any means that you are or might be engaging in illegal activities using Navimask, the contract will be terminated and the license revoked.

8.5 Cancellation for breach or other legal reasons. The contract will end and the license will be revoked if you fail to make the required payments or if any other cause that legally permits early termination of the contract is verified.

9.- CONFIDENTIALITY OF COMMUNICATIONS

9.1 Navimask does not allow ONTINET to observe or monitor user browsing details in any way, except as required by law or by court order.

 

10.- PERSONAL DATA PROTECTION

10.1 ONTINET will process your personal data for the purposes stated in this contract, particularly to enable you to enjoy Navimask, provide the required technical support, and collect the amounts due for the licenses.

10.2 ONTINET may send you advertising or promotional communications about its own products and services that are similar to Navimask, within the field of cybersecurity. You can opt out of these communications during the subscription process and at any time thereafter.

10.3 Under no circumstances will your personal data be subject to automated decisions.

10.4 The personal data you provide for the subscription to Navimask will be retained for as long as necessary to fulfill the purposes for which it was collected, and once these purposes are completed, the data will be kept blocked for the time during which liabilities arising from the processing could be claimed, and only for the statute of limitations period.

10.5 If you are dissatisfied with the way we handle your personal data, and you have contacted us without resolving your complaint, you may contact the Spanish Data Protection Agency (AEPD) at aepd.es.

11.- LEGISLATION, LANGUAGE, AND DISPUTE RESOLUTION

11.1 This Agreement is governed in all respects by Spanish law. The language of drafting and interpretation of this Agreement is Spanish. This Agreement will not be individually archived for each subscription but will remain accessible via the Internet on the ONTINET website: https://www.ontinet.com/

11.2 Users who qualify as consumers or users according to Spanish regulations and reside in the European Union, if they have had an issue with an online subscription made with ONTINET, may attempt to reach an out-of-court agreement through the Online Dispute Resolution Platform:

11.3 When the Navimask user cannot be considered a consumer or user according to the applicable regulations, they agree to submit to the jurisdiction of the courts and tribunals of Valencia, Spain.
